What is it?

Individuals and entities, both public and private, can file a complaint of discrimination if they consider that they have been directly or indirectly affected by a situation of discrimination.

You can also file a complaint if you have witnessed or are aware of possible discrimination due to any of these situations:

  • regional or national origin, and xenophobia
  • sex or gender, sexual orientation or identity, and any form of LGBTI-phobia or misogyny
  • ageism
  • race, ethnic origin or skin colour, and any form of racism such as anti-Semitism or antigypsyism
  • language or cultural identity
  • ideology, political or other opinion or ethical convictions of a personal nature
  • religious convictions or any manifestation of Islamophobia, Christianophobia or Judeophobia
  • social or economic condition, administrative situation, profession or condition of deprivation of liberty, or any manifestation of aporophobia or hatred of homeless people
  • physical, sensory, intellectual or mental disability or other types of functional diversity
  • health alterations, serological status or genetic characteristics
  • physical appearance or clothing
  • any other characteristic, circumstance or manifestation of the human condition, real or attributed, that is recognised by international legal instruments

You can only initiate this procedure in person if you are a natural person (individual).

Self-employed people, professionals, companies, organisations and other groups must conduct the procedure online. Documentation you provide through another channel will not be taken into account nor will it be valid for the purposes of the submission date.

If you have suffered discrimination in the workplace, you must file the complaint with the Catalan Labour Inspectorate. You can do it electronically by clicking the report link to the Labour Inspectorate.

This procedure is enabled so that they can help you from a face-to-face service office listed below, where the person who attends you can carry out the procedure on your behalf, with your consent.

To find out if the discrimination you are reporting is a minor, serious or very serious offence, you must consult the following regulations:

  • Equal treatment and non-discrimination: Law 19/2020, of 30 December, on equal treatment and non-discrimination.
  • Lesbian, gay, bisexual, transgender and intersex rights: Law 11/2014, of 10 October, to guarantee the rights of lesbians, gays, bisexuals, transgender and intersex people and to eradicate homophobia, biphobia and transphobia.

    If you are not an individual you can only do it online. The documentation you provide through another channel will not be taken into account nor will it be valid for the purposes of the submission date.

    If you are an individual, you can submit the complaint online without a CATMóbil ID or digital certificate. You will be summoned to sign the complaint in person, otherwise it will not be valid.

    If the electronic office does not work, you will see a message that says so. This message will tell you where you can submit the documentation in an alternative way and what the effects of the service interruption are.

    To submit the documentation, you can directly contact: 

    • The Equal Treatment and Non-Discrimination Office.
    • The electronic registry of the administration or body to which it is addressed, as well as the other electronic registries of the General State Administration, the administrations of the autonomous communities, the entities that make up the local administration and the institutional public sector.  
    • The registration assistance offices or at any of the digitisation and registration points of the Generalitat.
    • Post offices. 
    • Diplomatic representations or consular offices of Spain abroad. See the addresses.

    You have to register the discrimination complaint entry record sheet and, in a sealed envelope, submit:

    • Thediscrimination complaint form.
    • The attached documentation, if you have it.

    Other considerations:

    • You must indicate only one person per application.
    • If you file the complaint at a post office, you must do so with an open envelope, so that the staff of the entity can date and stamp the application.
    • Once you have sent the application, and as long as the procedure is not finished, you can provide documentation from the status of the procedureor by accessing the Private area.

    There is no specific timeframe. The relevant authority assesses the complaint, initiates the appropriate actions and, finally, will notify you of the result of these actions.

    You will receive an email notification. You can access the notification through the e-NOTUM service.

    If you are an individual and have chosen to receive a notification to the postal address, you will receive the reply to the two addresses indicated on the form (email and postal).
